Hearing in the alleged murder case pitting John Fru Ndi and Co was halted and adjourned to 11 June following disagreement over strange evidence in a case file before the President of the court, Gilbert Schlick, given to him by the State Counsel. Defence Lawyers were skeptical about the process through which the said file got to the court and that the evidence contained in the file may influence his objectivity on the matter. According to Lawyer Benjamin Suh Fuh, there are documents in the file which have not been tendered as exhibit through a witness, and which if used, may tempt the judge to go into it and look through those documents.

The Mfoundi High Court in Yaounde has ruled that enough evidence has been found against the Chairman of the Social Democratic Front, SDF, John Fru Ndi and co., accused of the murder of Gregoire Diboule on 26 May 2006 and they would have to present their defence in court. This was in a court session on Thursday 26 May 2009. Apparently a session to allow the members of the Civil party to present their submission, the defence was taken aback when the prosecution requested the permission for a last witness to be heard.
